49 year old Linda Boggess of Ventura was convicted on four counts of workers compensation insurance fraud by a jury of her peers, the Ventura County DA announced. Boggess is a former employee of the Ventura County Human Services Agency.
In March of 2007 Boggess filed a claim for workers compensation benefits claiming she was experiencing “paralyzing pain.”
Boggess began receiving medical treatments as well as temporary disability payments all the way until November of 2011, at that time she was cleared to return to her job without any restrictions. Not long after she returned to work Boggess found another doctor who provided new restrictions that she could lift no more than five pounds.
In January of 2012, Ventura County which self-insures their workers compensation claims, opened an investigation into Boggess.
Investigators took video surveillance showing Boggess carrying tires mounted on wheels weighing around 45 pounds for a distance of about 50 feet.
In March of 2012, Boggess testified at her deposition that she was unable to carry anything heavier than a gallon of milk.
Boggesss is scheduled to be sentenced on July 26, 2016 at 8 a.m. in Ventura County Superior COurt. She is facing a fine of $150,000 and up to 8 years in local prison.
