OH Supreme Court Orders Staffing Company to Pay Back Workers Comp Premiums

The Ohio Supreme Court ordered a Columbus, OH staffing agency to pay back unpaid workers’ compensation premiums that were owed by the temporary agency that it took over.

Daily Services is a temp agency owned by Ryan Mason that focuses on short-term or daily staffing. They also own I-Force, a temp agency focused on long-term staffing.

In 2008 I-Force’s workers’ compensation premiums were increased to $3.5 million because of its poor claims history. The Ohio Bureau of Workers’ Compensation performed an audit in April 2009 which showed that I-Force had actually closed in March 2009 but the business was operating through Daily Services.

In a 4-3 ruling the Ohio Supreme Court ordered Daily Services to pay back almost $3.5 million in unpaid workers’ comp premiums. This decision overturns a lower decision made by the Franklin County Court of Appeals which ruled in favor of Daily Services.
